Terms of Service

These Terms of Service ("Terms") govern your use of the Infinity Padel scoreboard service and any related hardware ("the service"). By using the service or subscribing, you agree to these Terms. In these Terms, "we", "us" and "our" mean Infinity Padel (ABN 75 941 646 983), and "you" means the club, venue or business using the service.

The service

We provide cloud-based digital scoreboard software for padel, including per-court displays, phone-based control, club branding and related features. We may add, change or remove features over time as the product develops.

Accounts

You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly if you believe your account has been accessed without authorisation. You must provide accurate information and keep it up to date.

Fees and billing

The service is provided on a subscription basis, with a one-time setup fee where applicable. Fees, billing frequency and what each plan includes will be set out when you sign up or in a separate quote. Subscriptions renew for successive periods unless cancelled before the renewal date. Unless required by law, fees already paid are non-refundable. We may change our fees on reasonable notice, with changes taking effect from your next billing period.

Cancellation

You may cancel your subscription effective at the end of your current billing period by contacting us. On cancellation your access to the service ends at the end of the paid period.

Acceptable use

You agree not to misuse the service, including attempting to gain unauthorised access, interfering with its operation, using it unlawfully, or using it to display unlawful, offensive or infringing content. You are responsible for the content you enter, including team and player names and any sponsor or advertising material you display.

Hardware

Where you purchase hardware from us, it is supplied subject to any quote or invoice and to your rights under the Australian Consumer Law. Setup, mounting and ongoing care may be covered by a separate arrangement.

Intellectual property

We own all rights in the service and its software. You own your own content and branding, and you grant us the limited right to host and display it as needed to provide the service. We may use your club name and logo to identify you as a customer unless you ask us not to.

Availability

We work to keep the service available and reliable, but we do not guarantee it will be uninterrupted or error free. The service depends on your internet connection and equipment, and on third-party providers such as our host. We may carry out maintenance and updates from time to time.

Consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes any rights you have that cannot lawfully be limited or excluded.

Limitation of liability

To the maximum extent permitted by law, and subject to the consumer guarantees above, we are not liable for indirect or consequential loss, lost profits or lost revenue, and our total liability to you for any claim is limited to the amount you paid us for the service in the twelve months before the claim.

Privacy

Our handling of personal information is described in our Privacy Policy.

Suspension and termination

We may suspend or end your access to the service if you breach these Terms or fail to pay fees when due, or where we are required to by law. On termination, the sections of these Terms that are meant to survive will continue to apply.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.

Changes to these Terms

We may update these Terms from time to time. The latest version will always be on this page with the date it was last updated. Continuing to use the service after a change means you accept the updated Terms.
